Assertion

By this Notice of Assertion, Leq’á:mel First Nation affirms its inherent rights, title, and responsibilities for its territory — encompassing everything above and below the land, from Leq’á:mel south to the Nooksack River, east to the Harrison Knob, northwest to the north shore of Stave Lake, and southwest to the northern shores of Alouette Lake and along the west side of Silver Creek.

Leq’á:mel gives formal notice to the Province of British Columbia, the Government of Canada, municipal and other governments, resource users and developers, and the general public that its inherent rights are currently, and will continue to be, asserted over its territory.

These rights include, but are not limited to, those reaffirmed by Section 35 of the Constitution of Canada and the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP).

Leq’á:mel has never ceded, surrendered, or abandoned its rights and responsibilities to its territory. Guided by traditional law and the teaching Letsémot Kwes Yoyestset (“work together with one heart and one mind”), the Nation continues to exercise its authority to manage, protect, and benefit from all resources within its lands and waters.

Leq’á:mel will engage in good faith dialogue with governments, developers, and the public to support understanding of their duty to enquire, engage, consult, and accommodate, consistent with the standard of free, prior, and informed consent.

This Notice of Assertion was formally adopted by Leq’á:mel Chief and Council on March 8, 2017.
